Prosecutors with the Manhattan District Attorney’s office are expected to rest their case Monday against Daniel Penny, the Marine veteran who is charged with manslaughter and negligent homicide in the chokehold death of a homeless man aboard a New York City subway car.

On Dec. 22, 1984, four black teenagers approached electronics specialist Bernhard Goetz, 37, on the New York City subway. After one of them said, “Give me five dollars,” Goetz pulled out a five-shot revolver and opened fire, injuring all four. Of these, one suffered a severed spinal cord, paralyzing him.

Testimony resumes Monday in the trial of Daniel Penny over the death of Jordan Neely. The prosecution is expected to wrap up its case soon.

The trial of Daniel Penny, the former Marine charged with killing Jordan Neely aboard a New York City subway, featured testimony from a man who helped the defendant restrain the victim.

Penny held Neely in a chokehold for about six minutes — including for more than 50 seconds after Neely stopped moving — according to evidence presented in his criminal trial.

Jordan Neeley’s death was a direct result of the chokehold Daniel Penny held him in, a medical examiner testified Friday, rebutting assertions from the defense team that the former Marine did not apply enough pressure to kill the subway rider and that his death could have had some other cause.
